Terms and Conditions

1. Agreement to Terms
By accessing or using the services provided by Gigi Row ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
These terms apply to all services offered through Gigi Row, including Gigi Row: Boost (creator management), Gigi Row: Build (software development), and Gigi Row: Brand (marketing services).
2. Services
Gigi Row provides digital services including but not limited to:
- Creator management and social media consulting
- Software development and automation
- Marketing materials and content creation
- Document design and business materials
Specific deliverables, timelines, and pricing will be agreed upon in writing before work commences.
3. Quotes and Pricing
All prices are quoted in Australian Dollars (AUD) unless otherwise specified. Quotes are valid for 30 days from the date of issue unless otherwise stated.
We reserve the right to adjust pricing for projects that exceed the original scope. Any changes to scope or pricing will be communicated and agreed upon in writing before additional work is undertaken.
4. Payment Terms
Payment terms vary by service type:
- Projects under $500: Full payment upon completion
- Projects $500-$2,000: 50% deposit upfront, 50% upon completion
- Projects over $2,000: Payment schedule to be agreed in writing
Invoices are due within 14 days of issue unless otherwise agreed. Late payments may incur additional fees.
5. Intellectual Property
Upon full payment, you receive ownership of all deliverables created specifically for your project, except:
- Pre-existing materials, tools, or frameworks owned by Gigi Row
- Third-party assets or licenses (which remain subject to their original terms)
- Generic components that may be reused in other projects
We retain the right to showcase completed work in our portfolio unless otherwise agreed in writing.
6. Client Responsibilities
You agree to:
- Provide accurate and timely information required for the project
- Review and provide feedback within reasonable timeframes
- Ensure you have rights to any materials you provide (logos, images, content)
- Pay invoices according to agreed terms
Delays caused by late or incomplete information may affect project timelines and costs.
7. Revisions
Unless otherwise specified in your quote:
- Projects include up to 2 rounds of revisions
- Additional revisions may be charged at our standard hourly rate
- Revisions must be requested within 14 days of delivery
8. Cancellation and Refunds
If you cancel a project:
- Before work begins: Full refund of any deposits paid
- After work begins: You will be charged for work completed to date
We reserve the right to terminate a project if payment terms are not met or if the working relationship becomes unworkable. In such cases, you will be charged for work completed.
9. Warranties and Limitations
We warrant that our services will be performed with reasonable care and skill. However:
- We do not guarantee specific results (follower growth, revenue increases, etc.)
- Software is provided "as is" after acceptance testing
- We are not liable for issues caused by third-party services or platforms
To the maximum extent permitted by law, our total liability is limited to the amount paid for the specific service in question.
10. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation that cannot be excluded by agreement.
If you are a consumer, you may have certain rights that cannot be excluded, including guarantees that services will be provided with due care and skill and be fit for any specified purpose.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
12. Confidentiality
We treat all client information as confidential. We will not share your business information, strategies, or project details with third parties without your consent, except as required by law.
13. Dispute Resolution
If a dispute arises, we will first attempt to resolve it through good-faith negotiation. If that fails, disputes will be resolved through mediation before any legal action is taken. These terms are governed by the laws of Australia.
14. Changes to Terms
We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
